侵权“Tiger”鞋遭罚款5587北京通报近20年最大商标侵权案

近期,北京市工商局发布了2018年“打击侵犯商标专用权和制售假冒伪劣商品”十大案例,包括查处涉及“苹果”、“BMW”、“壳牌”等侵犯注册商标专用权的案件。其中,由北京市工商局丰台分局查处的一起销售侵犯“Tiger”注册商标专用权案,是近20年来北京市场监管部门查处的最大一起商标侵权案件。

据悉,北京宏源利得商贸有限公司经营销售的运动鞋所使用的标识与株士会社爱世克斯(ASICS)的“Tiger”注册商标构成商标近似,易使消费者产生混淆误认。北京市工商局丰台分局依法责令该公司停止侵权行为,并作出没收侵权鞋6687双,罚款5587万余元的行政处罚决定。

Beijing Announces Largest Trademark Infringement Case in Two Decades

Recently, the Beijing Municipal Administration for Industry and Commerce reported on improvements that have occurred in copyright and trademark enforcement.  It announced the top ten cases, which included the largest trademark case in two decades as well as cases involving the unauthorized use of well-known registered trademarks like Apple, BMW and Shell.

The largest case for two decades involved a local company that had been selling ‘Tiger’ branded shoes without the authorization of the trade mark owner, Japanese footwear company Onitsuke Tiger.  The market regulators in the Fengtal District ordered the company to pay more than 55 million yuan  (approx. US$ 8,000,000) and confiscated 6,687 pairs of infringing shoes.  

 

日本“无印良品”一审败诉 未来在第24类商标或只能称MUJI

北京棉田纺织品有限公司起诉日本无印良品母公司株式会社良品计划及其中国分公司无印良品(上海)商业有限公司侵犯其商标权并胜诉。

一审判决书称,“无印良品”商标由海南南华实业贸易公司注册,核定使用在第24类棉织品等产品,并在2004721日转让给北京棉田纺织品,涉案的中国“无印良品”商标经过长期宣传和使用已具备极高的知名度。据此,法院裁定日本无印良品公司侵害了北京棉田纺织品的“无印良品”商标权,日本无印良品需赔偿其62万元人民币。这意味着,日本无印良品未来在中国销售的产品或只能标示“MUJI”。

目前日本无印良品方面已经提出上诉,一审判决尚未生效。即使上述判决生效,判决的对象也是仅针对北京棉田纺织品有限公司所享有的第24类商标。

Owner of Chinese Character Version of MUJI Trademark succeeds at First Instance

Beijing Miantian Textile Products Co.,Ltd. (Beijing Miantian), owner of the Chinese character version of the MUJI trademark, succeeded at first instance in a trademark infringement action against Ryohin Keikaku, the Japanese operator of MUJI store chain, and its Chinese subsidiary MUJI (Shanghai) Co., Ltd. .

The mark,无印良品. had been registered by Hainan Nanhua Co., Ltd. (Hainan Nanhua) in Class 24, and the registration assigned to the Plaintiff, Beijing Miantian, on 21 July 2004. On the ground that the Plaintiff’s trademark had gained much popularity as a result of long-term publicity and use, the Court ruled that MUJI had infringed and ordered it to pay compensation of RMB 620,000 (approx. US$ 90,000) . This means that, in future, MUJI would not be able to use the Chinese character mark on its Class 24 products.

Ryohin Keikaku (MUJI Japan) has appealed the decision.

 

乐高维权成功,19起诉讼一审胜诉

乐高公司始建于1932年,是世界知名玩具制造商,其代表产品是塑胶拼插积木玩具,以及主题动画、书籍等周边产品。近日,广东省广州市越秀区人民法院就乐高公司起诉汕头市美致模型有限公司等四被告不正当竞争及著作权侵权19起纠纷案作出一审判决,要求四被告立即停止侵权及不正当竞争行为,共计赔偿原告经济损失470万元。

针对双方争议焦点,法院经审理后认为:首先,涉案经拼装完成的立体模型及相应乐高小人偶属于我国著作权法所保护的美术作品范畴。被告对作品进行局部非实质性改动,未使其脱离原作品的基本表达,两作品构成实质性相似。被告生产、销售被诉侵权产品的行为侵犯了原告享有的复制权、发行权。

其次,在四被告是否构成不正当竞争行为问题上,法院确定了涉案玩具的包装、装潢属于知名商品特有的包装和装潢,玩具相关主要角色也应当受到反不正当竞争法的保护。而被控侵权产品的装潢与乐高公司产品的装潢基本相同,足以导致相关消费者产生混淆与误认。被告与原告属于同业竞争关系,被告不正当地获取本不属于其的交易机会,损害了原告的交易机会和竞争优势,行为存在明显过错,构成不正当竞争行为。

Lego Company succeeds at First Instance in Copyright and Unfair Competition actions

Preventing the copying of its iconic colourful plastic bricks and other products has been a major problem for Lego in China.  Recently, however, it had another success, when the People’s Court of Yuexiu District in Guangzhou found in its favour at first instance in actions for copyright infringement and unfair competition against four Defendants including Shantou Meizhi Model Co., Ltd.

The four Defendants were required to immediately stop the infringement and unfair competition, and compensate the Plaintiff for economic losses of 4.7 million yuan (approx. USD 681,327). 

The Court held that Lego’s 3D models and small figures constituted artistic works protected by China's Copyright Law. As the variations made by the Defendants were not substantial, they had reproduced the works without authority and therefore infringed the Plaintiff’s copyright. 

It further held that the Defendants’ use of similar packaging and decoration was likely to cause confusion and amounted to unfair competition. 

 

“剑网2018”专项整治,57万部涉嫌侵权盗版短视频遭删除

根据“剑网2018”专项行动部署安排,9月14日,国家版权局约谈了抖音短视频、快手、西瓜视频、火山小视频、美拍等15家重点短视频平台,责令相关企业进一步提高版权保护意识,加强内部版权制度建设。经过整改,15家重点短视频平台企业大力清理下架涉嫌侵权盗版的短视频作品,针对涉嫌侵权盗版的违规账号建立黑名单制度。各短视频平台企业积极清理自查,完善版权投诉处理机制,加强维权管理,及时受理权利人的投诉。抖音、西瓜、秒拍等平台通过与中国音乐著作权协会以及相关新闻单位、唱片公司、影视公司等开展版权合作的方式,加强内容版权管理。

为有效整治短视频行业侵权问题,规范行业健康发展,构建良好网络版权环境,国家版权局还将进一步通过行政约谈、行政处罚、刑事打击等手段,加强对短视频平台企业的版权监管.

Action taken by National Copyright Administration’s SwordNet 2018 to protect short-form videos 

On 14 September2018, the National Copyright Administration (NCAC) interviewed the operators of 15 key short-form mobile video platforms, including TikTok, Kuai Shou, Ixigua, Huoshan, and Meipai, and ordered them to further improve copyright protection systems.

Following these interviews, the short-form mobile videos platforms vigorously cleaned out short video works suspected of infringement and piracy; established a blacklist system for suspected illegal accounts; improved their mechanisms for handling copyright complaints; and strengthened the management of rights protection. Platforms such as TikTok, Ixigua and Miaopai also agreed to cooperate with the China Music Copyright Association and related news organizations, record companies, and film and television companies, to manage the potential risk of infringement.
