Full electronic service coming to Russia's Rospatent

In mid-December the draft law On changes to part four of Civil Code of RF was enacted at the panel session of Governmental Committee on digital development, use of IT for improving the quality of life and conditions of conduction of entrepreneurial activity.  

The draft law provides for the following:

  • filing of 3D models for registration of IP objects;
  • introduction of electronic registration certificates;
  • possibility of simple electronic signature in relation to some procedures with Rospatent.

The draft bill is designed to greatly improve efficiency by providing for more work to be conducted online.

The draft law proposes changes to Art. 1375, 1376, 1377, 1492 of Civil Code of Russia giving the applicant the ability to attach 3D models to the application for inventions, utility models, industrial designs and Trade Marks. 

3D models filed in this way will be coded and stored and available for searching. Thus, over time not only will the application process be streamlined, but so too searching.

The introduction of electronic registration certificates (for Trade Marks, including well-known Trade Marks, Patents, Industrial Designs, topologies of integral microcircuits and geographical indications) as well as the change to Art. 1246 of Civil Code of Russia, allowing to use simple electronic signature (which is a combination of login and password) will provide for the switch to fully electronic provision of services by Rospatent.

Implementation is planned before 2021.
